Summary: In this document Bishop Vicente Arbeláez protests a new decree by means of which the government of Nueva Granada expropriated property from the Catholic Church. He defends the right of the Church to hold private property so long as the church respects the rule of law.
Historical Notes: The disamortization decree was issued on September 9th, 1861 and abolished the inalienable right to tenure of property by institutions, primarily the Catholic Church. The disamortization decree was issued by Tomás Cipriano Mosquera’s administration along with other decrees that affected the Catholic Church, including decrees that expelled the Jesuits and one that closed the houses of some religious orders.
